Narrative:

9/88 I flew a radio broadcaster and an engineer from radio at waco, tx, for 1 hour, 10 mins prior to football game. I flew with my radio tuned to waco approach control 119.3 and my transponder to 1200 and my DME to waco VORTAC 115.3 in VFR conditions. I did not contact waco approach control during the first 10 or 15 mins because I took off from my flying heart ranch airport which is located 10 NM southeast of the waco control tower on the 125 degree right of the waco VORTAC, was circling the stadium which is located 9 SM from the control tower on madison cooper airport. After I contacted waco approach control I told them I was flying in the vicinity of the baylor stadium at 1500' and squawking 1200. Controller informed me to squawk another number and fly at 2000' MSL or higher as there was another airplane flying in that area at 1500'. Controller informed me to call the tower after I landed. After landing, the controller informed me the pilot of the other aircraft reported a near miss with me. Controller said I was in the waco air traffic area before I called him. He stated I was in violation. I told him I did not believe I was in the air traffic area. He did not know what action would be taken against me.

Narrative: 9/88 I FLEW A RADIO BROADCASTER AND AN ENGINEER FROM RADIO AT WACO, TX, FOR 1 HR, 10 MINS PRIOR TO FOOTBALL GAME. I FLEW WITH MY RADIO TUNED TO WACO APCH CTL 119.3 AND MY TRANSPONDER TO 1200 AND MY DME TO WACO VORTAC 115.3 IN VFR CONDITIONS. I DID NOT CONTACT WACO APCH CTL DURING THE FIRST 10 OR 15 MINS BECAUSE I TOOK OFF FROM MY FLYING HEART RANCH ARPT WHICH IS LOCATED 10 NM SE OF THE WACO CTL TWR ON THE 125 DEG R OF THE WACO VORTAC, WAS CIRCLING THE STADIUM WHICH IS LOCATED 9 SM FROM THE CTL TWR ON MADISON COOPER ARPT. AFTER I CONTACTED WACO APCH CTL I TOLD THEM I WAS FLYING IN THE VICINITY OF THE BAYLOR STADIUM AT 1500' AND SQUAWKING 1200. CTLR INFORMED ME TO SQUAWK ANOTHER NUMBER AND FLY AT 2000' MSL OR HIGHER AS THERE WAS ANOTHER AIRPLANE FLYING IN THAT AREA AT 1500'. CTLR INFORMED ME TO CALL THE TWR AFTER I LANDED. AFTER LNDG, THE CTLR INFORMED ME THE PLT OF THE OTHER ACFT RPTED A NEAR MISS WITH ME. CTLR SAID I WAS IN THE WACO ATA BEFORE I CALLED HIM. HE STATED I WAS IN VIOLATION. I TOLD HIM I DID NOT BELIEVE I WAS IN THE ATA. HE DID NOT KNOW WHAT ACTION WOULD BE TAKEN AGAINST ME.
