Narrative:

Flight cleared on loupe 4 departure sjc. Departure requires climb out with flap/slat down until on 120 degree heading outbnd. During confign change (I was not flying but operating FGS, raising flaps/slats, managing power at same time). ATC cleared us 'out of 7000' on 120 degree heading, cleared pilot's discretion direct to cross sjc VOR at 11000', comply with remainder of departure.' I was busy operating things inside cockpit and at 11000' restriction didn't register, since day before we had been cleared to cross VOR at or above 11000'. We crossed sjc VOR at 12300' and at 14000' when departure switched us to bay departure. He said, 'did you realize your clearance was to cross the VOR at 11000'?' we offered to descend, but ATC said, 'just stay where you are, contact bay departure.' cause of non compliance due to (obviously) crew factor, but amendment to deviate from SID was long, complex and detailed while cockpit workload was high. Next time, I will not be so rushed to comply with ATC readback while cockpit workload is high. Also, set altitude alert to intermediate altitude restriction (11000') vice cleared altitude (FL230). A valuable lesson learned.

WE OFFERED TO DSND, BUT ATC SAID, 'JUST STAY WHERE YOU ARE, CONTACT BAY DEP.' CAUSE OF NON COMPLIANCE DUE TO (OBVIOUSLY) CREW FACTOR, BUT AMENDMENT TO DEVIATE FROM SID WAS LONG, COMPLEX AND DETAILED WHILE COCKPIT WORKLOAD WAS HIGH. NEXT TIME, I WILL NOT BE SO RUSHED TO COMPLY WITH ATC READBACK WHILE COCKPIT WORKLOAD IS HIGH. ALSO, SET ALT ALERT TO INTERMEDIATE ALT RESTRICTION (11000') VICE CLRED ALT (FL230).
