Narrative:

The first officer was the PF. We had just endured approximately 1 hour 30 min delay. He had clearly briefed the teb 5 departure off runway 24; climb runway heading to 1500 ft then right turn 280 degree heading; maintain 1500 ft till 4.5 DME then climb to 2000 ft. On climb out he flew through 1500 ft; I called out the deviation. He said 'no; 2000 ft' and did not level off till 2000 ft. I said the SID calls for 1500 ft till 4.5 DME and 280 degree heading. Then ny departure called and said we were supposed to be at 1500 ft. There was no conflict. It was a mistake. Perhaps too much time passed between the briefing and the takeoff clearance.

THEN NY DEP CALLED AND SAID WE WERE SUPPOSED TO BE AT 1500 FT. THERE WAS NO CONFLICT. IT WAS A MISTAKE. PERHAPS TOO MUCH TIME PASSED BETWEEN THE BRIEFING AND THE TKOF CLRNC.
