Narrative:

Crossing altitude relief. It was captain's leg and we had been given pilot's discretion to cross 40 mi west of bowie at FL240. After a frequency change and at about 50 mi from bowie, ATC asked us if we had been given a descent to FL240. I replied we had been given pilot's discretion, and that we needed relief on the crossing. At about 47 mi out, ATC cleared us to cross bambee at 11000 ft. I said thanks and he said 'no problem' so I think he gave us the relief we requested.

Title: MD80 CREW DID NOT COMPLY WITH AN ATC ISSUED XING RESTR IN ZFW CLASS A AIRSPACE.

Narrative: XING ALT RELIEF. IT WAS CAPT'S LEG AND WE HAD BEEN GIVEN PLT'S DISCRETION TO CROSS 40 MI W OF BOWIE AT FL240.
