Narrative:

During departure from san jose, was at assigned altitude of 5000 ft. When reporting to next sector, controller advised traffic, and to maintain 7000 ft. Read back 7000 ft and began climb. Controller then asked altitude and I reported 6000 ft. Controller asked what altitude I was assigned and I reiterated 7000 ft and reported traffic in sight. Tcad did not go off (alert) so I don't think there was likely a separation conflict. However, I think the controller erred in the assignment of 7000 ft.

Title: A PVT PLT FLYING A PIPER SINGLE ENG ACFT FROM SJC FAILED TO MAINTAIN ALT AS ASSIGNED BY ATC.

Narrative: DURING DEP FROM SAN JOSE, WAS AT ASSIGNED ALT OF 5000 FT. WHEN RPTING TO NEXT SECTOR, CTLR ADVISED TFC, AND TO MAINTAIN 7000 FT. READ BACK 7000 FT AND BEGAN CLB. CTLR THEN ASKED ALT AND I RPTED 6000 FT. CTLR ASKED WHAT ALT I WAS ASSIGNED AND I REITERATED 7000 FT AND RPTED TFC IN SIGHT. TCAD DID NOT GO OFF (ALERT) SO I DON'T THINK THERE WAS LIKELY A SEPARATION CONFLICT. HOWEVER, I THINK THE CTLR ERRED IN THE ASSIGNMENT OF 7000 FT.
