Narrative:

Tower operator at bhm was not communicating well because he had just failed to issue landing clearance to a B737 which had to go around. He was having trouble talking to other aircraft on ground. (Tower was also ground control.) we were cleared to taxi into position and hold after a crj jet departed. After the crj was well clear of the end of the runway, we taxied onto the runway to hold. The tower said we had done an illegal movement but we were cleared for takeoff anyway. Private pilot (owner) was in the right seat and heard the same clearance I did.

Title: ATCT CTLR AT BHM WORKING LCL COMBINED WITH GND WAS APPARENTLY BEHIND CTLING TFC AND MAY HAVE UNKNOWINGLY TAXIED AN ACFT INTO POS ON THE RWY.
