Narrative:

Palm beach county noise abatement officials have forced carriers flying stage ii aircraft to use reduced power settings on departure or be fined. ATC doesn't know when these B727's are going to implement these procedures. Aircraft X departed pbi. Aircraft Y departed behind aircraft X with standard separation. Aircraft X had to be turned left and aircraft Y had to be turned right to avoid a midair. This scenario has occurred more than a dozen times in the past 60 days. Aircraft X stated he was following company policy.

Title: ARPT NOISE ABATEMENT PROC REQUIRES CERTAIN TYPES OF ACFT TO REDUCE SPD AFTER TKOF. CTLR RELEASED AN MD88 BEHIND A B727 WITH STANDARD SEPARATION, HOWEVER, THE FIRST ACFT REDUCED SPD TO COMPLY WITH THE NOISE PROC CAUSING THE SECOND ACFT TO OVERTAKE THE FIRST ACFT. THE CTLR VECTORED BOTH ACFT TO AVOID A CONFLICT.
