Narrative:

My client trnee was manipulating the controls during a VOR approach into lwm. He was locked onto the VOR centerline at 1250' asl, had just called out 3.3 DME from velan FAF, 100 KIAS. Our aircraft X had landing light on. I was scanning from left to right when I saw the 2 humongous engines with rotating propellers 50' vertical and at time of spotting 50-150' horizontal (I never before realized I had peripheral vision on the top of my eyes). Aircraft Z, with dark blue trim, was spotted over my right shoulder to the rear quarter (Z came from the north; we were on lwm 057 degree right inbound to velan FAF, 3.3 DME-lwm, course 237 degrees, heading 245-250 degrees. I took immediate evasive action by grabbing the yoke, diving and turning right (now his fuselage was directly over our nose). Trnee, sensing something was wrong, threw off his goggles in time to see the dirty, oily belly and the wheels down of the other aircraft. All he heard from me was, 'ohhh.' normal cockpit management procedure is for me to say, 'I have the controls,' and him to respond, 'you have the controls.' tower at not time called either aircraft Z or X traffic. Since there was no 'aluminum to aluminum,' I returned the controls to trnee with the above verbiage. I will be getting a copy of the tapes. Tower finally answered me following my second call. Z pilot answered my tower cal with sarcasm, like, 'I was watching you; I saw you turn right (we think he meant procedure turn inbound). It's VFR, anyhow.' tower said, 'Z, I told you to enter a right base for 23.' I think pilot Z was confused heading for runway 32. More than confused, I think he has an attitude problem, as he said he was watching us, yet he did not adhere to far 91.113, causing a near miss. I called the tower on land-line directly after landing and then drove to where the tower said he had parked. No sign of life at the aircraft. 20 mins at most, he parked postflted, tied down and got the hell out. Unfortunately, the tower chief was unable to reach me within 2 hours and had to report to hotline. Will remedial training help the other pilot if he has a good attitude (which he did not demonstrate)? Had the tower called out traffic, this may have been avoided. Had pilot Z verbalized the correct runway 23 and knew where he was in space, had the aircraft Z not intentionally violated far's and safety, this could have been avoided.

I TOOK IMMEDIATE EVASIVE ACTION BY GRABBING THE YOKE, DIVING AND TURNING RIGHT (NOW HIS FUSELAGE WAS DIRECTLY OVER OUR NOSE). TRNEE, SENSING SOMETHING WAS WRONG, THREW OFF HIS GOGGLES IN TIME TO SEE THE DIRTY, OILY BELLY AND THE WHEELS DOWN OF THE OTHER ACFT. ALL HE HEARD FROM ME WAS, 'OHHH.' NORMAL COCKPIT MGMNT PROC IS FOR ME TO SAY, 'I HAVE THE CTLS,' AND HIM TO RESPOND, 'YOU HAVE THE CTLS.' TWR AT NOT TIME CALLED EITHER ACFT Z OR X TFC. SINCE THERE WAS NO 'ALUMINUM TO ALUMINUM,' I RETURNED THE CTLS TO TRNEE WITH THE ABOVE VERBIAGE. I WILL BE GETTING A COPY OF THE TAPES. TWR FINALLY ANSWERED ME FOLLOWING MY SECOND CALL. Z PLT ANSWERED MY TWR CAL WITH SARCASM, LIKE, 'I WAS WATCHING YOU; I SAW YOU TURN RIGHT (WE THINK HE MEANT PROC TURN INBND). IT'S VFR, ANYHOW.' TWR SAID, 'Z, I TOLD YOU TO ENTER A RIGHT BASE FOR 23.' I THINK PLT Z WAS CONFUSED HDG FOR RWY 32. MORE THAN CONFUSED, I THINK HE HAS AN ATTITUDE PROB, AS HE SAID HE WAS WATCHING US, YET HE DID NOT ADHERE TO FAR 91.113, CAUSING A NEAR MISS. I CALLED THE TWR ON LAND-LINE DIRECTLY AFTER LNDG AND THEN DROVE TO WHERE THE TWR SAID HE HAD PARKED. NO SIGN OF LIFE AT THE ACFT. 20 MINS AT MOST, HE PARKED POSTFLTED, TIED DOWN AND GOT THE HELL OUT. UNFORTUNATELY, THE TWR CHIEF WAS UNABLE TO REACH ME WITHIN 2 HRS AND HAD TO RPT TO HOTLINE. WILL REMEDIAL TRNING HELP THE OTHER PLT IF HE HAS A GOOD ATTITUDE (WHICH HE DID NOT DEMONSTRATE)? HAD THE TWR CALLED OUT TFC, THIS MAY HAVE BEEN AVOIDED. HAD PLT Z VERBALIZED THE CORRECT RWY 23 AND KNEW WHERE HE WAS IN SPACE, HAD THE ACFT Z NOT INTENTIONALLY VIOLATED FAR'S AND SAFETY, THIS COULD HAVE BEEN AVOIDED.
