Cleared dande intersection direct grann, cleared to FL380. Level at FL380, ZSU switched radio to new york comrdo operator on 130.7 for oceanic. Approximately 95 mi south of grann, received TA, then RA to climb. Aircraft was visually acquired, we climbed, B767 descended. We passed directly overhead of B767. We were both at assigned altitude of FL380, and on assigned course. Mix-up was with ZSU and new york oceanic controllers. New york comrdo operator was advised immediately.

ACFT WAS VISUALLY ACQUIRED, WE CLBED, B767 DSNDED. WE PASSED DIRECTLY OVERHEAD OF B767. WE WERE BOTH AT ASSIGNED ALT OF FL380, AND ON ASSIGNED COURSE. MIX-UP WAS WITH ZSU AND NEW YORK OCEANIC CTLRS. NEW YORK COMRDO OPERATOR WAS ADVISED IMMEDIATELY.
