Narrative:

We were estimating 55n040w at XA43Z czqx radio called us to advise us we were to cross 040W no later than XA40. We realized we could not cut 3 min off our flight time to 40W with only 27 min to go to 40W. We advised czqx radio we would be unable to cross 40W any sooner than XA41. They acknowledged but did not cancel our clearance. We then heard them clear a company flight behind us to slow so as to cross 40W no earlier than XA42. We maintained our increased airspeed so as to cross 40W at XA42, then resumed assigned mach number. I contacted our ATC liaison, who contacted the supervisor at gander. He happened to be working that night and wasn't even aware of a problem. He agreed the clearance was a bad one and would talk with controller. My concern was: a clearance was given and not complied with and not cancelled or amended. Appears to be a non-event.

Title: MD11 FLT CREW IS CONFUSED OVER THEIR REVISED CLRNC AND XING TIME FOR 40W WHEN ALLEGING INADEQUATE COM PROCS BY CTLR WHILE ON FREQ WITH CZQX.

Narrative: WE WERE ESTIMATING 55N040W AT XA43Z CZQX RADIO CALLED US TO ADVISE US WE WERE TO CROSS 040W NO LATER THAN XA40. THEY ACKNOWLEDGED BUT DID NOT CANCEL OUR CLRNC. WE THEN HEARD THEM CLR A COMPANY FLT BEHIND US TO SLOW SO AS TO CROSS 40W NO EARLIER THAN XA42. WE MAINTAINED OUR INCREASED AIRSPD SO AS TO CROSS 40W AT XA42, THEN RESUMED ASSIGNED MACH NUMBER. I CONTACTED OUR ATC LIAISON, WHO CONTACTED THE SUPVR AT GANDER. HE HAPPENED TO BE WORKING THAT NIGHT AND WASN'T EVEN AWARE OF A PROB. HE AGREED THE CLRNC WAS A BAD ONE AND WOULD TALK WITH CTLR. MY CONCERN WAS: A CLRNC WAS GIVEN AND NOT COMPLIED WITH AND NOT CANCELLED OR AMENDED. APPEARS TO BE A NON-EVENT.
