Narrative:

After departure from runway 24 at teb, we were established on the 280 degree heading and leveling at 1500 ft. We were speaking to ny departure control and thought they had given us the climb instructions to maintain 2000 ft. We were wrong. We should have been at 1500 ft until 250 degree, 4.5 DME of teb. Controller advised us of the SID and cleared us to 10000 ft. This was an oversight on the crew's part of the teb 5 departure.

Title: A CL604 CAPT ADMITTED THAT HE AND HIS FO ASSUMED A CLB CLRNC WAS FOR THEM AND CLBED ABOVE THE TEB SID RESTR.

Narrative: AFTER DEP FROM RWY 24 AT TEB, WE WERE ESTABLISHED ON THE 280 DEG HDG AND LEVELING AT 1500 FT. WE WERE SPEAKING TO NY DEP CTL AND THOUGHT THEY HAD GIVEN US THE CLB INSTRUCTIONS TO MAINTAIN 2000 FT. WE WERE WRONG. WE SHOULD HAVE BEEN AT 1500 FT UNTIL 250 DEG, 4.5 DME OF TEB. CTLR ADVISED US OF THE SID AND CLRED US TO 10000 FT. THIS WAS AN OVERSIGHT ON THE CREW'S PART OF THE TEB 5 DEP.
