Narrative:

Took off IFR from hpn runway 16. SID (runway heading to 800 ft, right turn to 320 degree heading, maintaining 3000 ft) (repos flight to teb), switched to ny departure, reported climbing to 3000 ft, ny departure replied 'maintain 3000 ft.' no other communication with ny except for 'radio check' since frequency was quiet for a couple of mins, ny departure replied 'loud and clear.' a couple of mins after that a TCASII TA sounded off, with a traffic at our 12-1 O'clock position, 100 ft below us. Followed by a TCASII RA, 'climb' initiated immediate climb to 3500 ft until 'clear of conflict.' other aircraft descended, both aircraft called the RA maneuver to ny departure with no reply from them, until queried again. Their reply was 'roger.' no further problem after that. Ny departure did not appear to be overloaded (light radio traffic). TCASII saved the day! Not sure what ny departure did or did not do.

Narrative: TOOK OFF IFR FROM HPN RWY 16. SID (RWY HEADING TO 800 FT, R TURN TO 320 DEG HDG, MAINTAINING 3000 FT) (REPOS FLT TO TEB), SWITCHED TO NY DEP, RPTED CLBING TO 3000 FT, NY DEP REPLIED 'MAINTAIN 3000 FT.' NO OTHER COM WITH NY EXCEPT FOR 'RADIO CHK' SINCE FREQ WAS QUIET FOR A COUPLE OF MINS, NY DEP REPLIED 'LOUD AND CLR.' A COUPLE OF MINS AFTER THAT A TCASII TA SOUNDED OFF, WITH A TFC AT OUR 12-1 O'CLOCK POS, 100 FT BELOW US. FOLLOWED BY A TCASII RA, 'CLB' INITIATED IMMEDIATE CLB TO 3500 FT UNTIL 'CLR OF CONFLICT.' OTHER ACFT DSNDED, BOTH ACFT CALLED THE RA MANEUVER TO NY DEP WITH NO REPLY FROM THEM, UNTIL QUERIED AGAIN. THEIR REPLY WAS 'ROGER.' NO FURTHER PROB AFTER THAT. NY DEP DID NOT APPEAR TO BE OVERLOADED (LIGHT RADIO TFC). TCASII SAVED THE DAY! NOT SURE WHAT NY DEP DID OR DID NOT DO.
