Narrative:

Cleared to 7000 ft on a heading of 090 degrees, passing 5500 ft, departure control gave us a clearance to descend to 5000 ft and turn left to 310 degrees. TA alert sounded, visually acquired traffic at 11 O'clock position, 5 NM and +400 ft. Disconnected autoplt, turned and descended smoothly, closest point of approach was 3-4 NM and +400 ft. I believe this incident was controller error. Supplemental information from acn 508042: the departure controller gave traffic at 11 O'clock, 400 ft above us and directed us to descend to 5000 ft. We received a TA on TCASII, but no RA. The departure controller apologized. The other aircraft appeared to be an ATR under approach control jurisdiction. No other information was obtained.
