Narrative:

Flight departed lga with original clearance to 5000 ft. During climb out, departure reclred flight to a higher altitude and new heading. Captain read back new altitude of 14000 ft. No response was made by ATC. Passing 9000 ft, ATC questioned flight as to the altitude they were climbing to. Captain answered '14000 ft assigned.' ATC responded by telling flight to level at present altitude. Leveled at approximately 9300 ft and returned to 9000 ft. ATC then reclred to 10000 ft and new frequency. Nothing was mentioned by the controller about any possible conflict or the possible deviation. This flight was the last leg on the last day of a 4 day trip. Day 4 was particularly tiring and long. This was 11 hours 26 mins after an early sign-in.

Title: A B757 FLC FAILED TO MAINTAIN ASSIGNED ALT ON DEP FROM LGA.

Narrative: FLT DEPARTED LGA WITH ORIGINAL CLRNC TO 5000 FT. DURING CLBOUT, DEP RECLRED FLT TO A HIGHER ALT AND NEW HDG. CAPT READ BACK NEW ALT OF 14000 FT. NO RESPONSE WAS MADE BY ATC. PASSING 9000 FT, ATC QUESTIONED FLT AS TO THE ALT THEY WERE CLBING TO. CAPT ANSWERED '14000 FT ASSIGNED.' ATC RESPONDED BY TELLING FLT TO LEVEL AT PRESENT ALT. LEVELED AT APPROX 9300 FT AND RETURNED TO 9000 FT. ATC THEN RECLRED TO 10000 FT AND NEW FREQ. NOTHING WAS MENTIONED BY THE CTLR ABOUT ANY POSSIBLE CONFLICT OR THE POSSIBLE DEV. THIS FLT WAS THE LAST LEG ON THE LAST DAY OF A 4 DAY TRIP. DAY 4 WAS PARTICULARLY TIRING AND LONG. THIS WAS 11 HRS 26 MINS AFTER AN EARLY SIGN-IN.
