Narrative:

We were given the sjc loupe 9 departure to cross at or above, we thought above anyway. Sjc VOR at 12000 ft climb and maintain FL230 after our turn the crossing of the VOR was at 12900 ft. As we continued our climb to FL230 departure asked if we were given 12000 ft at sjc VOR. We thought we could continue our climb to FL230.
