The flight crew was given the sjc loupe 9 departure to cross at or above (the crew thought at or above anyway) the sjc VOR at 12000 ft and climb and maintain FL230. After the turn the crossing of the VOR was at 12900 ft. As they continued the climb to FL230 departure asked if they were given 12000 ft at sjc VOR. The crew thought they could continue on to FL230.
