Narrative:

We were in cruise at FL330 north of J152 for WX, with a clearance direct har when able. We cleared the WX south of us and proceeded to har. We were then cleared to cross 40 NM west of har at FL250. I programmed a waypoint 45 mi west of har and started a vertical descent with the arc on the waypoint (no significant WX on radar) as we descended through an overcast layer, we entered a building cumulus and encountered moderate turbulence. I selected a slower speed -- slowed the descent, and made a right turn for turbulence and WX avoidance. As cockpit activity increased, we were given a frequency change from one ZOB to another. We advised them of the deviation but inadvertently did not mention the slowed descent and inability to make the restr at 40 DME. The next controller was also advised of the deviation but not the slowed descent or inability to make the crossing restr. We were approximately 2000 ft high at the 40 DME fix due to the deviation and slowed descent. I feel the unexpected intensity of the turbulence combined with the concern for flight attendant and passenger safety contributed to our omission to ATC of our inability to make the crossing.

THE NEXT CTLR WAS ALSO ADVISED OF THE DEV BUT NOT THE SLOWED DSCNT OR INABILITY TO MAKE THE XING RESTR. WE WERE APPROX 2000 FT HIGH AT THE 40 DME FIX DUE TO THE DEV AND SLOWED DSCNT. I FEEL THE UNEXPECTED INTENSITY OF THE TURB COMBINED WITH THE CONCERN FOR FLT ATTENDANT AND PAX SAFETY CONTRIBUTED TO OUR OMISSION TO ATC OF OUR INABILITY TO MAKE THE XING.
