Narrative:

During cruise at FL310 we received a TCASII RA, 'climb, climb.' we complied with the 2000-2500 FPM pitch up command immediately. We notified ATC and were told a T38 had climbed to FL290 just beneath, leveling off sharply. When the TCASII no longer showed a RA/TA and controller verified there was no conflict, we descended from FL322 to FL310. No 'clear of conflict' was announced.

Title: ALTDEV ALT EXCURSION -- ACR RECEIVED A TCASII 'RA' AND CLBS AS INSTRUCTED, BUT THE INTRUDER LEVELS OFF 2000 FT BELOW THEIR ASSIGNED ALT AFTER A RAPID CLB.

Narrative: DURING CRUISE AT FL310 WE RECEIVED A TCASII RA, 'CLB, CLB.' WE COMPLIED WITH THE 2000-2500 FPM PITCH UP COMMAND IMMEDIATELY. WE NOTIFIED ATC AND WERE TOLD A T38 HAD CLBED TO FL290 JUST BENEATH, LEVELING OFF SHARPLY. WHEN THE TCASII NO LONGER SHOWED A RA/TA AND CTLR VERIFIED THERE WAS NO CONFLICT, WE DSNDED FROM FL322 TO FL310. NO 'CLR OF CONFLICT' WAS ANNOUNCED.
