Narrative:

On oct/xx/94, a WW24 new-AR6 destination checked on frequency leaving FL270 or FL280 climbing to FL390. The WW24 was 30 east mcb. At the same time, a B727 was 10 south mei direct das at FL250. Observing the possible situation when aircraft may pass less than 5 mi, I measured the time when separation would be lost, subtracted 3 mins, and cleared the WW24 to cross that point in time at or above FL370. The WW24's pilot accepted the clearance. 30 seconds before the WW24 was to reach FL370, I observed the aircraft leaving FL340. I questioned the pilot to verify he would meet the restr. He advised he didn't think so. I turned the WW24 to a 270 degree heading and the B727 to a 150 degree heading. Aircraft passed within 7 mi of each other.

THE WW24'S PLT ACCEPTED THE CLRNC. 30 SECONDS BEFORE THE WW24 WAS TO REACH FL370, I OBSERVED THE ACFT LEAVING FL340. I QUESTIONED THE PLT TO VERIFY HE WOULD MEET THE RESTR. HE ADVISED HE DIDN'T THINK SO. I TURNED THE WW24 TO A 270 DEG HDG AND THE B727 TO A 150 DEG HDG. ACFT PASSED WITHIN 7 MI OF EACH OTHER.
