Narrative:

Descended en route into holding and level at 14000 over benky with TCASII indicating other aircraft at 12000 and 13000. Rolled out on outbound leg, approximately 1 min later, TCASII depicted another aircraft at our 2 O'clock also at 14000 ft. We asked ATC to confirm our assigned altitude and current altitude. He replied 14000 ft and also advised of VFR traffic. Upon turning inbound again, a conflict arose with the same aircraft Y, a twin, possible turboprop. TCASII gave an RA and we turned and descended and announced same to ATC. Our descent was approximately 1000 ft. Upon climbing back up and so advising, ATC indicated we could stay at 13000 ft. We discontinued our climb at 13400 ft and descended to 13000 ft. Other aircraft Y was involved in parachute jumping at ottawa airport. Concerns: ATC indicated he was giving advisories to Y, was aware of his position, and is under a directive not to refuse an altitude to jumpers, only suggest a height and release point. FAA protection of holding airspace. If ATC is not going to control location of VFR aircraft, they still have the responsibility of controling IFR aircraft to avoid any conflict. This was not done, resulting in evasive action. Closest point of approach approximately 1 mi.

Title: ACR IN HOLDING HAS TCASII RA REF SKYDIVE ACFT IN COM WITH ATC.

Narrative: DSNDED ENRTE INTO HOLDING AND LEVEL AT 14000 OVER BENKY WITH TCASII INDICATING OTHER ACFT AT 12000 AND 13000. TCASII GAVE AN RA AND WE TURNED AND DSNDED AND ANNOUNCED SAME TO ATC. OUR DSCNT WAS APPROX 1000 FT. UPON CLBING BACK UP AND SO ADVISING, ATC INDICATED WE COULD STAY AT 13000 FT. WE DISCONTINUED OUR CLB AT 13400 FT AND DSNDED TO 13000 FT. OTHER ACFT Y WAS INVOLVED IN PARACHUTE JUMPING AT OTTAWA ARPT. CONCERNS: ATC INDICATED HE WAS GIVING ADVISORIES TO Y, WAS AWARE OF HIS POS, AND IS UNDER A DIRECTIVE NOT TO REFUSE AN ALT TO JUMPERS, ONLY SUGGEST A HEIGHT AND RELEASE POINT. FAA PROTECTION OF HOLDING AIRSPACE. IF ATC IS NOT GOING TO CTL LOCATION OF VFR ACFT, THEY STILL HAVE THE RESPONSIBILITY OF CTLING IFR ACFT TO AVOID ANY CONFLICT.
