Narrative:

First officer checked in with lax departure after takeoff. Departure assigned us 250 heading, climb to 13000 and maintain 250 KTS. At approximately 9600 ft, departure informed us that our assigned altitude was 9000 ft and to descend to 9000 ft. I started to level off and descend back to 9000 ft, but before I had the throttles halfway back we received a TCASII alert to climb. I acquired the traffic visually and started a left climbing turn to avoid the traffic. We were never closer than a mi and a half horizontal and 1200 ft vertical to the traffic. I informed the controller, that he had assigned us 13000 ft not 9000 ft. He said 'he may have, and that he could not remember.' after reaching las, I received a message to call lax departure. They asked me a few questions. Then they informed me that, they had reviewed the tapes and found that it was the controller's error and the controller had been decertified.

Narrative: FO CHKED IN WITH LAX DEP AFTER TKOF. DEP ASSIGNED US 250 HDG, CLB TO 13000 AND MAINTAIN 250 KTS. AT APPROX 9600 FT, DEP INFORMED US THAT OUR ASSIGNED ALT WAS 9000 FT AND TO DSND TO 9000 FT. I STARTED TO LEVEL OFF AND DSND BACK TO 9000 FT, BUT BEFORE I HAD THE THROTTLES HALFWAY BACK WE RECEIVED A TCASII ALERT TO CLB. I ACQUIRED THE TFC VISUALLY AND STARTED A L CLBING TURN TO AVOID THE TFC. WE WERE NEVER CLOSER THAN A MI AND A HALF HORIZ AND 1200 FT VERT TO THE TFC. I INFORMED THE CTLR, THAT HE HAD ASSIGNED US 13000 FT NOT 9000 FT. HE SAID 'HE MAY HAVE, AND THAT HE COULD NOT REMEMBER.' AFTER REACHING LAS, I RECEIVED A MESSAGE TO CALL LAX DEP. THEY ASKED ME A FEW QUESTIONS. THEN THEY INFORMED ME THAT, THEY HAD REVIEWED THE TAPES AND FOUND THAT IT WAS THE CTLR'S ERROR AND THE CTLR HAD BEEN DECERTIFIED.
