Narrative:
Air carrier X departing mia for tgu. We were cleared to FL330 from mia center and then handed off to havana center. We requested FL410. They gave us a heading of 210 degrees climb to FL410. As we started the climb, we noticed aircraft Y on TCASII 1500 ft above on the nose. At that point, TCASII RA commanded a climb. We complied and missed by 1000 ft and 1 mi.

Title: ACR X CLB THROUGH OCCUPIED ALT TCASII RA CLB HAD LTSS FROM ACFT Y. SYS ERROR. EVASIVE ACTION TAKEN.
Narrative: ACR X DEPARTING MIA FOR TGU. WE WERE CLRED TO FL330 FROM MIA CTR AND THEN HANDED OFF TO HAVANA CTR. WE REQUESTED FL410. THEY GAVE US A HDG OF 210 DEGS CLB TO FL410. AS WE STARTED THE CLB, WE NOTICED ACFT Y ON TCASII 1500 FT ABOVE ON THE NOSE. AT THAT POINT, TCASII RA COMMANDED A CLB. WE COMPLIED AND MISSED BY 1000 FT AND 1 MI.
