Narrative:

When lga is landing ILS runway 4 the aircraft cross the OM (peths) lga 221R 3.9 DME at 1319 ft. An aircraft can be clear of the TCA more than 6 DME below 1500 ft. With the standard 500 FPM rate of descent this poses a safety problem. I have seen a traffic reporting small aircraft aircraft X less than 200 ft from aircraft on approach. This problem was given to the lga facility advisory board who passed it on to FAA eastern region office. The response received back was it was a rare occurrence, and to change the TCA map would be too much work. This small aircraft X has a routine making several passes through that area. There are also banner tows that have gone through that area. I feel nothing will be done until tragedy with loss of life occurs. With numerous heavy jets going through this area on the approach, wake turbulence will probably be the cause!

Title: CTLR COMPLAINS ABOUT ACFT OPERATING BELOW THE TCA AND THE POTENTIAL FOR CONFLICT WITH AN ACFT ON APCH TO RWY 4 AT LGA.

Narrative: WHEN LGA IS LNDG ILS RWY 4 THE ACFT CROSS THE OM (PETHS) LGA 221R 3.9 DME AT 1319 FT. AN ACFT CAN BE CLR OF THE TCA MORE THAN 6 DME BELOW 1500 FT. WITH THE STANDARD 500 FPM RATE OF DSCNT THIS POSES A SAFETY PROBLEM. I HAVE SEEN A TFC RPTING SMA ACFT X LESS THAN 200 FT FROM ACFT ON APCH. THIS PROBLEM WAS GIVEN TO THE LGA FACILITY ADVISORY BOARD WHO PASSED IT ON TO FAA EASTERN REGION OFFICE. THE RESPONSE RECEIVED BACK WAS IT WAS A RARE OCCURRENCE, AND TO CHANGE THE TCA MAP WOULD BE TOO MUCH WORK. THIS SMA X HAS A ROUTINE MAKING SEVERAL PASSES THROUGH THAT AREA. THERE ARE ALSO BANNER TOWS THAT HAVE GONE THROUGH THAT AREA. I FEEL NOTHING WILL BE DONE UNTIL TRAGEDY WITH LOSS OF LIFE OCCURS. WITH NUMEROUS HVY JETS GOING THROUGH THIS AREA ON THE APCH, WAKE TURB WILL PROBABLY BE THE CAUSE!
