Narrative:

Our aircraft was on takeoff roll at den, runway 35R. At about 100- 110 KIAS, the first officer's seat came loose on the track and slid full aft. First officer was flying at the time, could not reach rudder pedals. As aircraft initiated a slight right drift, captain elected to reject takeoff, took control of the aircraft and executed an uneventful reject. Aircraft required 1 hour, 40 mins ground time for brake cooling. Maintenance talked with company maintenance at louisville and requested interpretation of regulations. Decision was made to position seat to fit first officer's flying position and pin/lock seat in place. Item was deferred in logbook. Captain and crew were briefed on status and agreed with decision. Upon arrival at louisville after uneventful flight, we learned that dispatch had been invalid due to incorrect maintenance deferral. Company admitted it was a company mistake, that crew had not done anything wrong and had acted in good faith with understanding dispatch was legal. Company didn't believe any problem existed or any fallout would result but recommended filing of this report. Essentially a non event from aircrew perspective. Supplemental information from acn 189502: I assumed control and called for a rejected takeoff thinking we had lost an engine.
