Narrative:
We were level at 5000', heading 120 degrees at 4 KM north of sjc on loupe 7 departure. ATC cleared us to climb and maintain 12000'. At 5500' we received a TA from our TCAS of an aircraft at 4-5 mi ahead. A short time later, approaching 6000', we received an RA, 'monitor vertical speed,' advising us to discontinue climb. At this time I advised ATC of our situation (traffic indicating 2 KM ahead, 300' above us). Seconds later, TCAS commanded, 'descend, descend,' 1500 FPM. ATC said they 'now see the traffic,' and gave us a right turn turn to 190 degrees. At 5400' we received 'clear of conflict' from our tcs. ATC then cleared us to climb and maintain FL230 with a restriction of crossing sjc VOR at or below 12000'. Resumed flight west/O further incident.

Title: ACR MGL ALT DEVIATION EXCURSION FROM CLRNC ALT IN RESPONSE TO TCASII RA.
Narrative: WE WERE LEVEL AT 5000', HDG 120 DEGS AT 4 KM N OF SJC ON LOUPE 7 DEP. ATC CLRED US TO CLB AND MAINTAIN 12000'. AT 5500' WE RECEIVED A TA FROM OUR TCAS OF AN ACFT AT 4-5 MI AHEAD. A SHORT TIME LATER, APCHING 6000', WE RECEIVED AN RA, 'MONITOR VERT SPD,' ADVISING US TO DISCONTINUE CLB. AT THIS TIME I ADVISED ATC OF OUR SITUATION (TFC INDICATING 2 KM AHEAD, 300' ABOVE US). SECS LATER, TCAS COMMANDED, 'DSND, DSND,' 1500 FPM. ATC SAID THEY 'NOW SEE THE TFC,' AND GAVE US A RIGHT TURN TURN TO 190 DEGS. AT 5400' WE RECEIVED 'CLR OF CONFLICT' FROM OUR TCS. ATC THEN CLRED US TO CLB AND MAINTAIN FL230 WITH A RESTRICTION OF XING SJC VOR AT OR BELOW 12000'. RESUMED FLT W/O FURTHER INCIDENT.
