Narrative:

Upon advancing power levers the takeoff warning horn sounded. I noticed that the flaps were up and lowered them to takeoff position, during takeoff roll. Flaps were in the takeoff position before rotation. This judgement (to continue rather than abort) was a mistake, but felt it was my only choice. The FAA now violates anyone who aborts and does not return to the gate with a maintenance write-up. I had no write-up. We were distraction while performing the before takeoff checklist. Somehow we missed checking flaps and trim.

Title: ACR MLG GOT THE TKOF WARNING HORN AS POWER WAS ADVANCED. PIC SAW THAT THE FLAPS WERE NOT IN TKOF POSITION AND PUT THEM IN THE CORRECT POSITION AS THEY CONTINUED THE TKOF. CLAIMS IF HE HAD ABORTED THE TKOF HE WOULD HAVE HAD TO RETURN TO THE BLOCKS WITH A WRITE-UP.

THIS JUDGEMENT (TO CONTINUE RATHER THAN ABORT) WAS A MISTAKE, BUT FELT IT WAS MY ONLY CHOICE. THE FAA NOW VIOLATES ANYONE WHO ABORTS AND DOES NOT RETURN TO THE GATE WITH A MAINT WRITE-UP. I HAD NO WRITE-UP. WE WERE DISTR WHILE PERFORMING THE BEFORE TKOF CHKLIST. SOMEHOW WE MISSED CHKING FLAPS AND TRIM.
