Narrative:

Departed oxr on a single pilot operation of an small transport. I called mugu approach on 124.7 advised I was climbing VFR to 15500' en route to crq I was assigned a squawk and handed off to mugu 128.65. The controller advised me I had a commuter small transport Y overhead 8000' on a VFR on top descent and that that aircraft had me in sight. I advised I was climbing VFR out of 7100'. My passengers told me of an aircraft about to hit us. I turned to look to my left and saw small aircraft Y in a 35-40 degree bank and in a very steep descent which he continued to about 5500'. He then leveled off and proceeded direct toward lax west/O a word. He was in contact with the same controller as I. Both of us were in the controller's cone of silence so he did not see the near miss only the steep descent. The controller said the commuter had us in sight when he was 3 mi behind us. My passenger said he was first observed in a wings level descent to within 100' of us. He then broke hard left and descended. The controller was initiated at the commuter pilot because he had stated he had us in sight so far away. I don't know what happened and how these guys could come so close when they had us in sight! I asked the the controller what I could do in his area to avoid any future problem. He explained to me what goes on in his airspace and suggested a modified departure route to keep me clear of commuter aircraft flying overhead. I will use his route. The pilots flying the small aircraft Y's in our area are rude. They always race to get ahead of other aircraft inbound and obviously are not vigilant looking outside. A little more patience, a little more respect for our fellow pilots by each of us can go along way in helping us operate more safely.

Title: CLOSE PROX CPR SMT ON CLIMB OUT FROM OXR AND A COMMUTER SMT DES INTO THE AREA.

Narrative: DEPARTED OXR ON A SINGLE PLT OPERATION OF AN SMT. I CALLED MUGU APCH ON 124.7 ADVISED I WAS CLBING VFR TO 15500' ENRTE TO CRQ I WAS ASSIGNED A SQUAWK AND HANDED OFF TO MUGU 128.65. THE CTLR ADVISED ME I HAD A COMMUTER SMT Y OVERHEAD 8000' ON A VFR ON TOP DSNT AND THAT THAT ACFT HAD ME IN SIGHT. I ADVISED I WAS CLBING VFR OUT OF 7100'. MY PAXS TOLD ME OF AN ACFT ABOUT TO HIT US. I TURNED TO LOOK TO MY L AND SAW SMA Y IN A 35-40 DEG BANK AND IN A VERY STEEP DSNT WHICH HE CONTINUED TO ABOUT 5500'. HE THEN LEVELED OFF AND PROCEEDED DIRECT TOWARD LAX W/O A WORD. HE WAS IN CONTACT WITH THE SAME CTLR AS I. BOTH OF US WERE IN THE CTLR'S CONE OF SILENCE SO HE DID NOT SEE THE NEAR MISS ONLY THE STEEP DSNT. THE CTLR SAID THE COMMUTER HAD US IN SIGHT WHEN HE WAS 3 MI BEHIND US. MY PAX SAID HE WAS FIRST OBSERVED IN A WINGS LEVEL DSNT TO WITHIN 100' OF US. HE THEN BROKE HARD L AND DSNDED. THE CTLR WAS INITIATED AT THE COMMUTER PLT BECAUSE HE HAD STATED HE HAD US IN SIGHT SO FAR AWAY. I DON'T KNOW WHAT HAPPENED AND HOW THESE GUYS COULD COME SO CLOSE WHEN THEY HAD US IN SIGHT! I ASKED THE THE CTLR WHAT I COULD DO IN HIS AREA TO AVOID ANY FUTURE PROB. HE EXPLAINED TO ME WHAT GOES ON IN HIS AIRSPACE AND SUGGESTED A MODIFIED DEP RTE TO KEEP ME CLR OF COMMUTER ACFT FLYING OVERHEAD. I WILL USE HIS RTE. THE PLTS FLYING THE SMA Y'S IN OUR AREA ARE RUDE. THEY ALWAYS RACE TO GET AHEAD OF OTHER ACFT INBND AND OBVIOUSLY ARE NOT VIGILANT LOOKING OUTSIDE. A LITTLE MORE PATIENCE, A LITTLE MORE RESPECT FOR OUR FELLOW PLTS BY EACH OF US CAN GO ALONG WAY IN HELPING US OPERATE MORE SAFELY.
