Narrative:

While climbing toward pmd out of 16000' we were cleared to cross 8 DME at 21000'. We were 16 DME from pmd. Climb was initiated. Rate 2000 plus at speed 180 KTS indicated. As climb progressed it became evident the crossing restriction would be close. ATC queried if we would make the restriction. The response was 'not quite'. The controller turned our aircraft to the right. There was conflicting traffic at our 12 O'clock which was turned to the right. The traffic was in sight at the time of the turn. The situation was reviewed to find why the restriction was not met. The conclusion was, the speed of the aircraft was indicated not ground speed. The climb was into a ever increasing tailwind which shallowed the climb gradient. The problem should not have occurred. The captain should have realized the restriction would be close and no room for error was available.

Title: FLT CREW OF CPR SMT ACCEPTED CROSSING AT PMD OF 21000' BUT UNABLE TO MAKE THE CROSSING. CTLR TURNED CPR AND TRAFFIC TO PROVIDE SEPARATION.

Narrative: WHILE CLBING TOWARD PMD OUT OF 16000' WE WERE CLRED TO CROSS 8 DME AT 21000'. WE WERE 16 DME FROM PMD. CLB WAS INITIATED. RATE 2000 PLUS AT SPD 180 KTS INDICATED. AS CLB PROGRESSED IT BECAME EVIDENT THE XING RESTRICTION WOULD BE CLOSE. ATC QUERIED IF WE WOULD MAKE THE RESTRICTION. THE RESPONSE WAS 'NOT QUITE'. THE CTLR TURNED OUR ACFT TO THE R. THERE WAS CONFLICTING TFC AT OUR 12 O'CLOCK WHICH WAS TURNED TO THE R. THE TFC WAS IN SIGHT AT THE TIME OF THE TURN. THE SITUATION WAS REVIEWED TO FIND WHY THE RESTRICTION WAS NOT MET. THE CONCLUSION WAS, THE SPD OF THE ACFT WAS INDICATED NOT GND SPD. THE CLB WAS INTO A EVER INCREASING TAILWIND WHICH SHALLOWED THE CLB GRADIENT. THE PROB SHOULD NOT HAVE OCCURRED. THE CAPT SHOULD HAVE REALIZED THE RESTRICTION WOULD BE CLOSE AND NO ROOM FOR ERROR WAS AVAILABLE.
