Narrative:

Jan/fri/90 we departed hobby airport runway 17. Approximately 2 min later were changed to houston departure on 120.8. Were given several headings while climbing to 4000' per SID. Level 4000 told climb to 5000 and turn to heading 190. Approximately 30 second later told turn left to heading 130 and climb to 12,000. Were climbing at 250 KT and 1500 FPM. The traffic above us was hidden by our own aircraft's overhead structure until we rolled out on the assigned heading. The traffic (army fgt helicopter) appeared in the upper left pilot's windshield on a converging heading. Fgt heading approximately 30 degree from our own approximately 160 degree with a rapid closure rate. The fgt was level at 10,000'. We rolled wings level at 9500', sighted traffic and rolled hard right (90 degree evasive bank). We estimate the distance at 1/4 mi. Departure control was busy, the traffic was not called out to us. We were told later via phone with area supervisor the fgt was in contact with departure control but did not have mode C. He was 'advised' not to climb above 6000'.

Narrative: JAN/FRI/90 WE DEPARTED HOBBY ARPT RWY 17. APPROX 2 MIN LATER WERE CHANGED TO HOUSTON DEP ON 120.8. WERE GIVEN SEVERAL HDGS WHILE CLIMBING TO 4000' PER SID. LEVEL 4000 TOLD CLIMB TO 5000 AND TURN TO HDG 190. APPROX 30 SEC LATER TOLD TURN LEFT TO HDG 130 AND CLIMB TO 12,000. WERE CLIMBING AT 250 KT AND 1500 FPM. THE TFC ABOVE US WAS HIDDEN BY OUR OWN ACFT'S OVERHEAD STRUCTURE UNTIL WE ROLLED OUT ON THE ASSIGNED HDG. THE TFC (ARMY FGT HELI) APPEARED IN THE UPPER LEFT PLT'S WINDSHIELD ON A CONVERGING HDG. FGT HDG APPROX 30 DEG FROM OUR OWN APPROX 160 DEG WITH A RAPID CLOSURE RATE. THE FGT WAS LEVEL AT 10,000'. WE ROLLED WINGS LEVEL AT 9500', SIGHTED TFC AND ROLLED HARD RIGHT (90 DEG EVASIVE BANK). WE ESTIMATE THE DISTANCE AT 1/4 MI. DEP CTL WAS BUSY, THE TFC WAS NOT CALLED OUT TO US. WE WERE TOLD LATER VIA PHONE WITH AREA SUPVR THE FGT WAS IN CONTACT WITH DEP CTL BUT DID NOT HAVE MODE C. HE WAS 'ADVISED' NOT TO CLIMB ABOVE 6000'.
