Narrative:

After receipt of takeoff clearance on 32L at T1 intersection or ord, my first officer, as briefed, informed tower that the 3000' and 5 DME restriction would be uncertain because of our high gross weight. Only after receipt of the takeoff clearance and the climb out heading would we know which altitude restriction would apply. We were nearing 100 KTS (V1, 129 KTS) when ord tower told us to hold in position. Even though below V1, I elected to continue the takeoff because of no traffic conflict being imminent.
