Narrative:

Aircraft #1 in level flight at FL280 nwbnd. Aircraft #2 cleared to climb and maintain FL270 eastbound. Mode C readout of aircraft #2 showed FL280 approximately 5 NM northwest of aircraft #1. Aircraft #1 was vectored left, aircraft #2 was vectored left and told to expedite climb to FL290. It appears to be pilot error by aircraft #2. Review of audio tapes show aircraft #2 cleared to FL270 and read clearance.
