Narrative:

After takeoff the pilot not flying raised the gear lever to the up position; but the landing gear stayed in the down and locked position. We continued flying the aircraft and complying with all ATC instructions. When we were clear of the terminal area I called for the 'gear will not retract' checklist - both myself and the first officer were confident knowing that particular checklist does not exist; but to use caution we looked for it. At that point we placed the gear handle back to the 'down' position. No changes in the gear status were noted and '3 green' lights were still illuminated; indicating that the gear was safe. I contacted company maintenance and the flight duty officer and we all concurred that we had taken the proper course of action. Our flight was a short positioning flight so we proceeded to our planned destination without incident.
