ATC Human Performance
There were storms south and at zzzzz intersection. We asked for right deviation 30 mi 85 before zzzzzz and were told by ATC they could not give us that. We then asked for runways xxl and xyr and that was turned down also. They told us there was no traffic and to declare captain's emergency authority/authorized if we needed to deviate. We did and deviated right 10 mi and we were back on course 10 mi east of zzzzzz. The storms were probably 43000 ft tall and we were at FL390. No problems with traffic.
