Narrative:

I was giving a BFR to a person in his C140. At the time I did not know that he was out of his 2 yr 24 calendar month limit. He told me he was not. I checked over the plane logs and saw that it had just gotten an annual inspection. I looked at his logbook and he had quite a few hours in the last month. So I took his word that he was current; as he had to fly the plane in to the airport for his BFR. After doing an hour or more of ground; we checked out the plane and decided to go flying. After we got a safe distance from other aircraft/airports we began to climb to do some stalls. When this individual put in full power something in the engine quit working and we lost almost all power. After attempts to restart the airplane failed; we put the aircraft down on a road without hurting ourselves or anyone on the ground. At the time I assumed that since he was PIC and that it was his plane that I would not be involved in any action. However; I found out that the person I was flying with was not able to be PIC as he was out of BFR. Even though he told me he was still current. Also; since I was not tailwheel endorsed I was cited for flying a tailwheel without an endorsement. I think if the regulation on flight reviews was more clear then I would have known I could not have given this flight review. I did not endorse this person's logbook and I did not log any dual given time in his logbook. I never once flew the airplane nor did I even touch the controls. I do realize that as an instructor I held out to him and that I cannot do flight reviews in a tailwheel since I am not endorsed. However; this came after the incident. Please put out an advisory circular for BFR's with a checklist on what to cover and what is required of flight instructors. Just like the pilot has a checklist -- documents to check and so forth.

Title: A C140 ON A TRAINING FLT SUFFERED PWR LOSS DURING STALL RECOVERY AND THE PLT LANDED ON A ROAD.

Narrative: I WAS GIVING A BFR TO A PERSON IN HIS C140. AT THE TIME I DID NOT KNOW THAT HE WAS OUT OF HIS 2 YR 24 CALENDAR MONTH LIMIT. HE TOLD ME HE WAS NOT. I CHKED OVER THE PLANE LOGS AND SAW THAT IT HAD JUST GOTTEN AN ANNUAL INSPECTION. I LOOKED AT HIS LOGBOOK AND HE HAD QUITE A FEW HRS IN THE LAST MONTH. SO I TOOK HIS WORD THAT HE WAS CURRENT; AS HE HAD TO FLY THE PLANE IN TO THE ARPT FOR HIS BFR. AFTER DOING AN HR OR MORE OF GND; WE CHKED OUT THE PLANE AND DECIDED TO GO FLYING. AFTER WE GOT A SAFE DISTANCE FROM OTHER ACFT/ARPTS WE BEGAN TO CLB TO DO SOME STALLS. WHEN THIS INDIVIDUAL PUT IN FULL PWR SOMETHING IN THE ENG QUIT WORKING AND WE LOST ALMOST ALL PWR. AFTER ATTEMPTS TO RESTART THE AIRPLANE FAILED; WE PUT THE ACFT DOWN ON A ROAD WITHOUT HURTING OURSELVES OR ANYONE ON THE GND. AT THE TIME I ASSUMED THAT SINCE HE WAS PIC AND THAT IT WAS HIS PLANE THAT I WOULD NOT BE INVOLVED IN ANY ACTION. HOWEVER; I FOUND OUT THAT THE PERSON I WAS FLYING WITH WAS NOT ABLE TO BE PIC AS HE WAS OUT OF BFR. EVEN THOUGH HE TOLD ME HE WAS STILL CURRENT. ALSO; SINCE I WAS NOT TAILWHEEL ENDORSED I WAS CITED FOR FLYING A TAILWHEEL WITHOUT AN ENDORSEMENT. I THINK IF THE REG ON FLT REVIEWS WAS MORE CLR THEN I WOULD HAVE KNOWN I COULD NOT HAVE GIVEN THIS FLT REVIEW. I DID NOT ENDORSE THIS PERSON'S LOGBOOK AND I DID NOT LOG ANY DUAL GIVEN TIME IN HIS LOGBOOK. I NEVER ONCE FLEW THE AIRPLANE NOR DID I EVEN TOUCH THE CTLS. I DO REALIZE THAT AS AN INSTRUCTOR I HELD OUT TO HIM AND THAT I CANNOT DO FLT REVIEWS IN A TAILWHEEL SINCE I AM NOT ENDORSED. HOWEVER; THIS CAME AFTER THE INCIDENT. PLEASE PUT OUT AN ADVISORY CIRCULAR FOR BFR'S WITH A CHKLIST ON WHAT TO COVER AND WHAT IS REQUIRED OF FLT INSTRUCTORS. JUST LIKE THE PLT HAS A CHKLIST -- DOCUMENTS TO CHK AND SO FORTH.
