Narrative:

We were initially filed for the holtz 7 SID on our departure from lax to mem. We reviewed the SID and then received our pre departure clearance; which changed our SID to the laxx 5 departure. The SID instructed us to climb on a 250 degree heading from runway 25R; cross the smo R-160 at or below 3000 ft; then turn left heading 220 degrees for vector to assigned route. After takeoff from runway 25R; we complied with the instructions in the laxx 5 SID. We were on a heading of 220 degrees at 3000 ft; when socal departure asked us if the lax tower had cleared us to an altitude of 5000 ft. I responded that they had not. I thought he was referring to an oral instruction from the tower controller. I asked the first officer if he recalled the tower clearing us to 5000 ft and he agreed that we had not received that clearance. Socal departure then cleared us to 5000 ft. After we were clear of the lax traffic area; we reviewed our approach plates to verify that we had read the laxx 5 departure correctly. We verified that we had complied correctly with the specifications of the departure. Then we reviewed our pre departure clearance. It is there that we discovered our error. At the top of the pre departure clearance; it had changed our SID from the holtz 7 to the laxx 5. At the bottom of the pre departure clearance; it stated to maintain 5000 ft. I totally missed it. I was so focused on reprogramming the FMS with the route change; that I overlooked the altitude assignment at the bottom of the pre departure clearance. I also feel that fatigue was a major factor in this oversight. We departed sea on monday evening at XX13Z and flew to oak. We departed oak at YY27Z and arrived at lax at ZZ40Z. We went to the hotel and I only slept for 3 1/2 hours. I woke up and read the newspaper; hoping to go back to sleep; but I was unable to fall asleep again. I got up and went outside about AA00Z and exercised. I returned to the hotel about BB00Z to shower and dress for our departure from lax. I departed lax with about 3 1/2 hours of sleep in the past 38 hours. I was definitely not 100% mentally sharp. I feel that I would have certainly noticed the altitude assignment at the bottom of the pre departure clearance; if I had been well-rested and more mentally alert.

AFTER TKOF FROM RWY 25R; WE COMPLIED WITH THE INSTRUCTIONS IN THE LAXX 5 SID. WE WERE ON A HDG OF 220 DEGS AT 3000 FT; WHEN SOCAL DEP ASKED US IF THE LAX TWR HAD CLRED US TO AN ALT OF 5000 FT. I RESPONDED THAT THEY HAD NOT. I THOUGHT HE WAS REFERRING TO AN ORAL INSTRUCTION FROM THE TWR CTLR. I ASKED THE FO IF HE RECALLED THE TWR CLRING US TO 5000 FT AND HE AGREED THAT WE HAD NOT RECEIVED THAT CLRNC. SOCAL DEP THEN CLRED US TO 5000 FT. AFTER WE WERE CLR OF THE LAX TFC AREA; WE REVIEWED OUR APCH PLATES TO VERIFY THAT WE HAD READ THE LAXX 5 DEP CORRECTLY. WE VERIFIED THAT WE HAD COMPLIED CORRECTLY WITH THE SPECS OF THE DEP. THEN WE REVIEWED OUR PDC. IT IS THERE THAT WE DISCOVERED OUR ERROR. AT THE TOP OF THE PDC; IT HAD CHANGED OUR SID FROM THE HOLTZ 7 TO THE LAXX 5. AT THE BOTTOM OF THE PDC; IT STATED TO MAINTAIN 5000 FT. I TOTALLY MISSED IT. I WAS SO FOCUSED ON REPROGRAMMING THE FMS WITH THE RTE CHANGE; THAT I OVERLOOKED THE ALT ASSIGNMENT AT THE BOTTOM OF THE PDC. I ALSO FEEL THAT FATIGUE WAS A MAJOR FACTOR IN THIS OVERSIGHT. WE DEPARTED SEA ON MONDAY EVENING AT XX13Z AND FLEW TO OAK. WE DEPARTED OAK AT YY27Z AND ARRIVED AT LAX AT ZZ40Z. WE WENT TO THE HOTEL AND I ONLY SLEPT FOR 3 1/2 HRS. I WOKE UP AND READ THE NEWSPAPER; HOPING TO GO BACK TO SLEEP; BUT I WAS UNABLE TO FALL ASLEEP AGAIN. I GOT UP AND WENT OUTSIDE ABOUT AA00Z AND EXERCISED. I RETURNED TO THE HOTEL ABOUT BB00Z TO SHOWER AND DRESS FOR OUR DEP FROM LAX. I DEPARTED LAX WITH ABOUT 3 1/2 HRS OF SLEEP IN THE PAST 38 HRS. I WAS DEFINITELY NOT 100% MENTALLY SHARP. I FEEL THAT I WOULD HAVE CERTAINLY NOTICED THE ALT ASSIGNMENT AT THE BOTTOM OF THE PDC; IF I HAD BEEN WELL-RESTED AND MORE MENTALLY ALERT.
