Narrative:

Numerous delays out of phx and las; we left for jfk over 3 hours late. Starting the descent; fatigue was apparent. We were instructed to cross harty intersection at FL230. ATC started VNAV descent from FL370. FMC was properly configured and aircraft was on flight path. Descent progress was checked and normal. Both pilots got distraction momentarily by ATC clearance and at the same time the aircraft left VNAV path and slowed to 250 KTS. ATC inquired if the crossing restr was going to be met; at same moment the flight crew realized what was happening. Aircraft was 5000 ft high and we were reclred to cross stw at FL230. This last restr was met. There was no conflict with any other aircraft and ATC did not make any other inquiries.

Title: TIRED FLT CREW INBOUND TO JFK FAILS TO MAKE XING RESTR AT HARTY INTXN.

Narrative: NUMEROUS DELAYS OUT OF PHX AND LAS; WE LEFT FOR JFK OVER 3 HRS LATE. STARTING THE DSCNT; FATIGUE WAS APPARENT. WE WERE INSTRUCTED TO CROSS HARTY INTXN AT FL230. ATC STARTED VNAV DSCNT FROM FL370. FMC WAS PROPERLY CONFIGURED AND ACFT WAS ON FLT PATH. DSCNT PROGRESS WAS CHKED AND NORMAL. BOTH PLTS GOT DISTR MOMENTARILY BY ATC CLRNC AND AT THE SAME TIME THE ACFT LEFT VNAV PATH AND SLOWED TO 250 KTS. ATC INQUIRED IF THE XING RESTR WAS GOING TO BE MET; AT SAME MOMENT THE FLT CREW REALIZED WHAT WAS HAPPENING. ACFT WAS 5000 FT HIGH AND WE WERE RECLRED TO CROSS STW AT FL230. THIS LAST RESTR WAS MET. THERE WAS NO CONFLICT WITH ANY OTHER ACFT AND ATC DID NOT MAKE ANY OTHER INQUIRIES.
