Narrative:

PIC of flight from sante flight engineer, NM, to denver co. We were cleared to denver via the paoke 1 SID and as filed, and initial altitude to be assigned before departure. Prior to takeoff, we were cleared to our filed altitude of FL220. I understood this clearance to negate the 9000 ft 8 DME crossing restr indicated on the paoke 1 SID. Climbing through 9000 ft at 7.3 DME, we were asked by ATC (ZAB) if the restr was made. We responded by explaining our interpretation of the clearance to mean a continuous climb to our cleared altitude, and the 8 DME 9000 ft restr had been superseded. The controller responded by saying that they would prefer the restr be met in the future and cleared us to continue. I believe this situation occurred because I have had different controllers tell me different ways ATC expects us to execute the paoke 1 SID. In conclusion, this experience leads me to believe that it is better to follow any existing restr, regardless of altitude assigned.

Title: FLT CREW OF B190 FAILED TO COMPLY WITH XING RESTR ON PAOKE 1 DEP FROM SAF.

Narrative: PIC OF FLT FROM SANTE FE, NM, TO DENVER CO. WE WERE CLRED TO DENVER VIA THE PAOKE 1 SID AND AS FILED, AND INITIAL ALT TO BE ASSIGNED BEFORE DEP. PRIOR TO TKOF, WE WERE CLRED TO OUR FILED ALT OF FL220. I UNDERSTOOD THIS CLRNC TO NEGATE THE 9000 FT 8 DME XING RESTR INDICATED ON THE PAOKE 1 SID. CLBING THROUGH 9000 FT AT 7.3 DME, WE WERE ASKED BY ATC (ZAB) IF THE RESTR WAS MADE. WE RESPONDED BY EXPLAINING OUR INTERP OF THE CLRNC TO MEAN A CONTINUOUS CLB TO OUR CLRED ALT, AND THE 8 DME 9000 FT RESTR HAD BEEN SUPERSEDED. THE CTLR RESPONDED BY SAYING THAT THEY WOULD PREFER THE RESTR BE MET IN THE FUTURE AND CLRED US TO CONTINUE. I BELIEVE THIS SIT OCCURRED BECAUSE I HAVE HAD DIFFERENT CTLRS TELL ME DIFFERENT WAYS ATC EXPECTS US TO EXECUTE THE PAOKE 1 SID. IN CONCLUSION, THIS EXPERIENCE LEADS ME TO BELIEVE THAT IT IS BETTER TO FOLLOW ANY EXISTING RESTR, REGARDLESS OF ALT ASSIGNED.
