Narrative:

We were cleared to 16000 ft on climb out. Passing 14000 ft, center advised us of VFR traffic at 2 O'clock position, 5 mi. I looked out at 2 O'clock position and saw the traffic (I thought -- but it was not our traffic). Center said the traffic was at 15500 ft, and suggested that if we did not have the traffic, we should just stay at 15000 ft. The captain, who was working the radios, said 'we'll just zoom up to 16000 ft.' at precisely that moment, we got a 'descend' RA. I disconnected the autoplt and complied with the RA, and simultaneously, visually acquired the real traffic, which passed 400-500 ft above us. We both believe that the traffic was 12-1 O'clock position, not 2 O'clock position. Also, we never got a TA on the TCASII. Perhaps the other plane had a weak transponder. We think center should have directed us to level at 15000 ft until clear of the VFR traffic, or at least given us a vector.

Title: FLC OF B712 RECEIVED AND FOLLOWED TCASII RA NEAR PHL. ATC PROVIDED TA, BUT FLC OPTED TO CONTINUE CLB WITHOUT VISUAL ACQUISITION OF THE OTHER ACFT.

Narrative: WE WERE CLRED TO 16000 FT ON CLBOUT. PASSING 14000 FT, CTR ADVISED US OF VFR TFC AT 2 O'CLOCK POS, 5 MI. I LOOKED OUT AT 2 O'CLOCK POS AND SAW THE TFC (I THOUGHT -- BUT IT WAS NOT OUR TFC). CTR SAID THE TFC WAS AT 15500 FT, AND SUGGESTED THAT IF WE DID NOT HAVE THE TFC, WE SHOULD JUST STAY AT 15000 FT. THE CAPT, WHO WAS WORKING THE RADIOS, SAID 'WE'LL JUST ZOOM UP TO 16000 FT.' AT PRECISELY THAT MOMENT, WE GOT A 'DSND' RA. I DISCONNECTED THE AUTOPLT AND COMPLIED WITH THE RA, AND SIMULTANEOUSLY, VISUALLY ACQUIRED THE REAL TFC, WHICH PASSED 400-500 FT ABOVE US. WE BOTH BELIEVE THAT THE TFC WAS 12-1 O'CLOCK POS, NOT 2 O'CLOCK POS. ALSO, WE NEVER GOT A TA ON THE TCASII. PERHAPS THE OTHER PLANE HAD A WEAK XPONDER. WE THINK CTR SHOULD HAVE DIRECTED US TO LEVEL AT 15000 FT UNTIL CLR OF THE VFR TFC, OR AT LEAST GIVEN US A VECTOR.
