Narrative:

There is a possibility that my company and I operated illegally. The TCASII was deferred inoperative (and had been for a couple of days). The fom doesn't state a requirement for TCASII to operate in either rnp or rvsm airspace, but a nagging voice makes me wonder if this requirement has somehow been overlooked. If, in fact, TCASII is not required in the airspace, are we operating at the highest level of safety? Is this a deferral we want to carry for several flts in 1000 ft separation and no radar?

Title: A B757-200 FLT CREW QUESTIONS THE LEGALITY OF OPERATING IN THE RVSM AIRSPACE WITH THE TCASII DEFERRED.

Narrative: THERE IS A POSSIBILITY THAT MY COMPANY AND I OPERATED ILLEGALLY. THE TCASII WAS DEFERRED INOP (AND HAD BEEN FOR A COUPLE OF DAYS). THE FOM DOESN'T STATE A REQUIREMENT FOR TCASII TO OPERATE IN EITHER RNP OR RVSM AIRSPACE, BUT A NAGGING VOICE MAKES ME WONDER IF THIS REQUIREMENT HAS SOMEHOW BEEN OVERLOOKED. IF, IN FACT, TCASII IS NOT REQUIRED IN THE AIRSPACE, ARE WE OPERATING AT THE HIGHEST LEVEL OF SAFETY? IS THIS A DEFERRAL WE WANT TO CARRY FOR SEVERAL FLTS IN 1000 FT SEPARATION AND NO RADAR?
