Narrative:

03/wed/03, at approximately XA40 I penetrated the newly installed tfr around the ny class B 30 mile arc. I was on a local pleasure flight with a first time passenger. He reported feeling ill due to turbulence (windy with thermals) and requested to use a bathroom. The closest airport at the at time was N51. I approached and landed there and upon landing I was advised by unicom to park by the fueling area and report inside. Upon entering the office I was confronted by an FAA inspector demanding my credentials. He advised me that I had entered the ADIZ without the proper transponder code (I was squawking 1200 mode C). My passenger immediately went to the bathroom. The inspector made a telephone call to someone (perhaps ATC). He said nothing further to me about the incursion and did not speak to my passenger. I believe I have a right as PIC to deviate from any crash fire rescue equipment's and tfr's in an emergency. My passenger reported he was ill and I landed at the nearest airport for his well being. There was no safety issue.

Title: SMA PLT ENTERED NY ADIZ WITHOUT CLRNC, OR A DISCRETE XPONDER CODE.

Narrative: 03/WED/03, AT APPROX XA40 I PENETRATED THE NEWLY INSTALLED TFR AROUND THE NY CLASS B 30 MILE ARC. I WAS ON A LOCAL PLEASURE FLT WITH A FIRST TIME PAX. HE RPTED FEELING ILL DUE TO TURB (WINDY WITH THERMALS) AND REQUESTED TO USE A BATHROOM. THE CLOSEST ARPT AT THE AT TIME WAS N51. I APCHED AND LANDED THERE AND UPON LNDG I WAS ADVISED BY UNICOM TO PARK BY THE FUELING AREA AND RPT INSIDE. UPON ENTERING THE OFFICE I WAS CONFRONTED BY AN FAA INSPECTOR DEMANDING MY CREDENTIALS. HE ADVISED ME THAT I HAD ENTERED THE ADIZ WITHOUT THE PROPER XPONDER CODE (I WAS SQUAWKING 1200 MODE C). MY PAX IMMEDIATELY WENT TO THE BATHROOM. THE INSPECTOR MADE A TELEPHONE CALL TO SOMEONE (PERHAPS ATC). HE SAID NOTHING FURTHER TO ME ABOUT THE INCURSION AND DID NOT SPEAK TO MY PAX. I BELIEVE I HAVE A RIGHT AS PIC TO DEVIATE FROM ANY CFR'S AND TFR'S IN AN EMER. MY PAX RPTED HE WAS ILL AND I LANDED AT THE NEAREST ARPT FOR HIS WELL BEING. THERE WAS NO SAFETY ISSUE.
