Narrative:

Our aircraft was a scheduled air carrier IFR mcw to msp. Was held on ground for an SVFR arrival. That aircraft landed and ZMP released us for departure. On climb out we had to take evasive action due to the third aircraft entering our protected airspace. This third aircraft was not shown as a target on our TCASII. This aircraft made no radio calls and was operating in violation of the far. The field was below VFR minimums. This incident could have been avoided if all aircraft were required to: 1) have an operable transponder. 2) have an operable radio and in 2-WAY communications.

Title: AN AGCAT TYPE ACFT ENTERED THE MCW CLASS E AIRSPACE SURFACE AREA WITHOUT CLRNC WHEN CONDITIONS WERE LESS THAN VFR AND INCURRED AN NMAC WITH A DEP COMMUTER TWIN. LTT CAPT STATES THAT THE AGCAT WAS NORDO AND HAD NO XPONDER.

Narrative: OUR ACFT WAS A SCHEDULED ACR IFR MCW TO MSP. WAS HELD ON GND FOR AN SVFR ARR. THAT ACFT LANDED AND ZMP RELEASED US FOR DEP. ON CLBOUT WE HAD TO TAKE EVASIVE ACTION DUE TO THE THIRD ACFT ENTERING OUR PROTECTED AIRSPACE. THIS THIRD ACFT WAS NOT SHOWN AS A TARGET ON OUR TCASII. THIS ACFT MADE NO RADIO CALLS AND WAS OPERATING IN VIOLATION OF THE FAR. THE FIELD WAS BELOW VFR MINIMUMS. THIS INCIDENT COULD HAVE BEEN AVOIDED IF ALL ACFT WERE REQUIRED TO: 1) HAVE AN OPERABLE XPONDER. 2) HAVE AN OPERABLE RADIO AND IN 2-WAY COMS.
