Narrative:

I flew a 2-DAY trip with 5 legs the first day and 5 legs the second day. Because I had only 8 hours of rest, I was not legal to fly my last round trip on day 2. Scheduling never notified me that I was not legal, and I failed to double check scheduling, and I did fly my last round trip when it was not legal for me to do so. Day 1 started at XA26. I flew 5 legs day 1 for a total flight time of 5 hours 41 mins. I was 59 mins over the scheduled block due to WX. After midnight, about 2 hours late, I began my rest at XA30 local time. I decided to rest the minimum of 8 hours, which is published on the schedule. I figured scheduling would contact me if I was required to rest more than what was published on my schedule. Even though my cell phone was on all night, and I was contactable through the hotel phone, scheduling never called to change my rest. Day 2 started after 8 hours reduced rest with a XA00 local time departure. I was now flying day 2 with 5 legs scheduled. I was only legal to fly the first 3 legs, and I should have been notified by scheduling that I was not legal to do the last 2 legs due to inadequate rest. With 8 hours rest, a crew member is only legal to fly up to 9 hours within any 24 hour period. I began the illegal flight at XE42 local. While in the air and unaware of what had happened, I began flying in a period where my flight time totaled more than 9 hours in the last 24 hours. I flew exactly 9 ours 26 mins within the last 24 hours, 26 mins too much. It's my fault I didn't double check scheduling until it was too late, but it's not my job to make my schedules legal. I flew my schedule as it was published. The problem is that the published schedule didn't allow for me to be 59 mins over block on day 1. If I had realized the problem, I would have rested 9 hours reduced rest in order to complete day 2. Scheduling has the responsibility at my airline to make sure I have a legal schedule, and when I only rested 8 hours, they should have pulled me off my last round trip. Even though I was contactable at all times, I was never notified of the problem with my schedule. Supplemental information from acn 574523: the WX was bad that day, causing numerous delays. Upon returning to home base, the captain discovered that because of the delays from the previous day, we should have had a reduced rest of 9 hours. Fatigue was a factor. We flew all day in bad WX and arrived late to our overnight. It would help if the schedules were not written so close as to require reduced rest when the schedule was written.

Title: CREW SCHEDULING AND AN AIRLINE CREW FAIL TO NOTE UNTIL AFTER THE FACT THAT THE CREW IS IN NON COMPLIANCE WITH CREW LEGALITIES AFTER A DAY OF DELAYS DURING A FLT SEQUENCE THAT HAD NO ROOM FOR DELAYS.

Narrative: I FLEW A 2-DAY TRIP WITH 5 LEGS THE FIRST DAY AND 5 LEGS THE SECOND DAY. BECAUSE I HAD ONLY 8 HRS OF REST, I WAS NOT LEGAL TO FLY MY LAST ROUND TRIP ON DAY 2. SCHEDULING NEVER NOTIFIED ME THAT I WAS NOT LEGAL, AND I FAILED TO DOUBLE CHK SCHEDULING, AND I DID FLY MY LAST ROUND TRIP WHEN IT WAS NOT LEGAL FOR ME TO DO SO. DAY 1 STARTED AT XA26. I FLEW 5 LEGS DAY 1 FOR A TOTAL FLT TIME OF 5 HRS 41 MINS. I WAS 59 MINS OVER THE SCHEDULED BLOCK DUE TO WX. AFTER MIDNIGHT, ABOUT 2 HRS LATE, I BEGAN MY REST AT XA30 LCL TIME. I DECIDED TO REST THE MINIMUM OF 8 HRS, WHICH IS PUBLISHED ON THE SCHEDULE. DAY 2 STARTED AFTER 8 HRS REDUCED REST WITH A XA00 LCL TIME DEP. WITH 8 HRS REST, A CREW MEMBER IS ONLY LEGAL TO FLY UP TO 9 HRS WITHIN ANY 24 HR PERIOD. I BEGAN THE ILLEGAL FLT AT XE42 LCL. WHILE IN THE AIR AND UNAWARE OF WHAT HAD HAPPENED, I BEGAN FLYING IN A PERIOD WHERE MY FLT TIME TOTALED MORE THAN 9 HRS IN THE LAST 24 HRS. I FLEW EXACTLY 9 OURS 26 MINS WITHIN THE LAST 24 HRS, 26 MINS TOO MUCH. IT'S MY FAULT I DIDN'T DOUBLE CHK SCHEDULING UNTIL IT WAS TOO LATE, BUT IT'S NOT MY JOB TO MAKE MY SCHEDULES LEGAL. I FLEW MY SCHEDULE AS IT WAS PUBLISHED. THE PROB IS THAT THE PUBLISHED SCHEDULE DIDN'T ALLOW FOR ME TO BE 59 MINS OVER BLOCK ON DAY 1. IF I HAD REALIZED THE PROB, I WOULD HAVE RESTED 9 HRS REDUCED REST IN ORDER TO COMPLETE DAY 2. SCHEDULING HAS THE RESPONSIBILITY AT MY AIRLINE TO MAKE SURE I HAVE A LEGAL SCHEDULE, AND WHEN I ONLY RESTED 8 HRS, THEY SHOULD HAVE PULLED ME OFF MY LAST ROUND TRIP. EVEN THOUGH I WAS CONTACTABLE AT ALL TIMES, I WAS NEVER NOTIFIED OF THE PROB WITH MY SCHEDULE. SUPPLEMENTAL INFO FROM ACN 574523: THE WX WAS BAD THAT DAY, CAUSING NUMEROUS DELAYS. UPON RETURNING TO HOME BASE, THE CAPT DISCOVERED THAT BECAUSE OF THE DELAYS FROM THE PREVIOUS DAY, WE SHOULD HAVE HAD A REDUCED REST OF 9 HRS. FATIGUE WAS A FACTOR. WE FLEW ALL DAY IN BAD WX AND ARRIVED LATE TO OUR OVERNIGHT. IT WOULD HELP IF THE SCHEDULES WERE NOT WRITTEN SO CLOSE AS TO REQUIRE REDUCED REST WHEN THE SCHEDULE WAS WRITTEN.
