Narrative:

Prior to our takeoff, a P3 had cleared runway 31 and was holding on taxiway C with a maintenance problem. Upon being cleared for takeoff, I confirmed with the tower that the P3's tail was not only clear of the runway, but clear of the hold short line. Tower stated he was clear and we took off. As we passed the P3 during the roll, I observed the P3's tail 10+ ft over the hold short line into the movement area. Supplemental information from acn 563854: after salute and release, I heard conversation on ground control P3 orion on taxiway C had mechanical failure disabled nosewheel steering inoperative due hydraulic failure. I notified dispatch to advise mdt ATC P3 may be encroaching, not totally clear of runway turnoff. ATC should be accurate in assessment of aircraft location.

Title: ATC TWR LCL CTLR CLRS AN ACR FOR TKOF AFTER CONFIRMING, IN ERROR, THAT ANOTHER ACFT WAS CLR OF THE RWY.

Narrative: PRIOR TO OUR TKOF, A P3 HAD CLRED RWY 31 AND WAS HOLDING ON TXWY C WITH A MAINT PROB. UPON BEING CLRED FOR TKOF, I CONFIRMED WITH THE TWR THAT THE P3'S TAIL WAS NOT ONLY CLR OF THE RWY, BUT CLR OF THE HOLD SHORT LINE. TWR STATED HE WAS CLR AND WE TOOK OFF. AS WE PASSED THE P3 DURING THE ROLL, I OBSERVED THE P3'S TAIL 10+ FT OVER THE HOLD SHORT LINE INTO THE MOVEMENT AREA. SUPPLEMENTAL INFO FROM ACN 563854: AFTER SALUTE AND RELEASE, I HEARD CONVERSATION ON GND CTL P3 ORION ON TXWY C HAD MECHANICAL FAILURE DISABLED NOSEWHEEL STEERING INOP DUE HYD FAILURE. I NOTIFIED DISPATCH TO ADVISE MDT ATC P3 MAY BE ENCROACHING, NOT TOTALLY CLR OF RWY TURNOFF. ATC SHOULD BE ACCURATE IN ASSESSMENT OF ACFT LOCATION.
