Narrative:

On thur, I used the duat flight planner to plan a flight from dvt to fcm. I used the GPS or LORAN rteing option. The program generated 21 waypoints for this flight. I then chose the 'file flight plan' menu and the route entered was the 21 waypoints from the flight planner program. On fri at about XA30, I called dvt for my IFR clearance, with a response of 'clearance on request.' my taxi clearance was to runway 7R at B3, hold short of runway 7R (I had requested 7R). The taxi out and before takeoff checks were uneventful. Ground control then gave me the clearance which included several (about four) of those radial and distance waypoints from the duats flight plan, plus a couple others that phoenix approach control added in the beginning of the clearance. The clearance limit was brk (blake forest) which was one of those duats waypoints and about halfway to my requested destination. Since it was not a clearance to a point on the ground and did not contain an expect further clearance time, I asked them to check on the clearance as I did not believe this was a valid clearance. Ground control agreed and then we both agreed that it would be faster to depart dvt VFR and get the clearance from abq center. I then switched to dvt tower and called ready for takeoff. After one or two landing aircraft I was cleared for takeoff to maintain runway heading until advised. I started moving and doing the runway line up checks, which includes a check of the landing traffic. I immediately stopped as there was an aircraft on very short final (1/4 mile). I told the tower that I was holding for landing traffic and that I was over the yellow line. The tower apologized and said it was his fault, but did not give the landing aircraft a go around. So I again told the tower that I was over the yellow line. The tower controller then told the landing cessna to go around. I was then cleared for takeoff.

GND CTL THEN GAVE ME THE CLRNC WHICH INCLUDED SEVERAL (ABOUT FOUR) OF THOSE RADIAL AND DISTANCE WAYPOINTS FROM THE DUATS FLT PLAN, PLUS A COUPLE OTHERS THAT PHOENIX APCH CTL ADDED IN THE BEGINNING OF THE CLRNC. THE CLRNC LIMIT WAS BRK (BLAKE FOREST) WHICH WAS ONE OF THOSE DUATS WAYPOINTS AND ABOUT HALFWAY TO MY REQUESTED DEST. SINCE IT WAS NOT A CLRNC TO A POINT ON THE GND AND DID NOT CONTAIN AN EXPECT FURTHER CLRNC TIME, I ASKED THEM TO CHK ON THE CLRNC AS I DID NOT BELIEVE THIS WAS A VALID CLRNC. GND CTL AGREED AND THEN WE BOTH AGREED THAT IT WOULD BE FASTER TO DEPART DVT VFR AND GET THE CLRNC FROM ABQ CTR. I THEN SWITCHED TO DVT TWR AND CALLED READY FOR TAKEOFF. AFTER ONE OR TWO LNDG ACFT I WAS CLRED FOR TAKEOFF TO MAINTAIN RWY HDG UNTIL ADVISED. I STARTED MOVING AND DOING THE RWY LINE UP CHKS, WHICH INCLUDES A CHK OF THE LNDG TFC. I IMMEDIATELY STOPPED AS THERE WAS AN ACFT ON VERY SHORT FINAL (1/4 MILE). I TOLD THE TWR THAT I WAS HOLDING FOR LNDG TFC AND THAT I WAS OVER THE YELLOW LINE. THE TWR APOLOGIZED AND SAID IT WAS HIS FAULT, BUT DID NOT GIVE THE LNDG ACFT A GAR. SO I AGAIN TOLD THE TWR THAT I WAS OVER THE YELLOW LINE. THE TWR CTLR THEN TOLD THE LNDG CESSNA TO GAR. I WAS THEN CLRED FOR TAKEOFF.
