Narrative:

Flight conditions: in and out of IMC. Position: 14 DME from zfp VOR (freeport, bahamas). Communicating with fpo departure (mygf). First noticed traffic on TCASII +700 ft, 3 mi. At this time, we were unable to communicate with departure because of lengthy communication between departure and king air. As the king air approached our altitude in range approximately 400 ft above, visual contact was obtained. I began rocking my wings and prepared for aggressive right turn. The king air crossed in front and passed to the port of me. At this time, departure advised me of the traffic and that the king air was not supposed to be at that altitude. When handed off to ZMA, I advised them of the near midair collision. The rest of the flight was uneventful.

Title: NMAC BTWN A DEP BE1900 AND AN ARR KING AIR 14 NM FROM ZFP VOR, FO.

Narrative: FLT CONDITIONS: IN AND OUT OF IMC. POS: 14 DME FROM ZFP VOR (FREEPORT, BAHAMAS). COMMUNICATING WITH FPO DEP (MYGF). FIRST NOTICED TFC ON TCASII +700 FT, 3 MI. AT THIS TIME, WE WERE UNABLE TO COMMUNICATE WITH DEP BECAUSE OF LENGTHY COM BTWN DEP AND KING AIR. AS THE KING AIR APCHED OUR ALT IN RANGE APPROX 400 FT ABOVE, VISUAL CONTACT WAS OBTAINED. I BEGAN ROCKING MY WINGS AND PREPARED FOR AGGRESSIVE R TURN. THE KING AIR CROSSED IN FRONT AND PASSED TO THE PORT OF ME. AT THIS TIME, DEP ADVISED ME OF THE TFC AND THAT THE KING AIR WAS NOT SUPPOSED TO BE AT THAT ALT. WHEN HANDED OFF TO ZMA, I ADVISED THEM OF THE NMAC. THE REST OF THE FLT WAS UNEVENTFUL.
