Narrative:

During taxi out, on recall during the taxi checklist, the overhead light illuminated. The fdr 'off' light was illuminated. The MEL book was referenced and maintenance and operations notified. The MEL states the aircraft cannot be 'dispatched' from a maintenance base (ZZZ and XXX). We conferred with maintenance and dispatch and determined since we had blocked out from the gate that we were 'en route.' therefore, an 'en route MEL' was appropriate. Upon arrival at YYY, dispatch notified us that the interpretation of en route might be changed and the interpretation of en route might be changed and the company was trying to determine whether or not we were actually en route or not.

Title: A B737-400 WAS GIVEN AN ENRTE DEFERRAL FOR A FLT RECORDER FAILURE WHILE TAXIING FOR TKOF. CREW CONCERNED IF DEFERRAL LEGAL.

THE MEL STATES THE ACFT CANNOT BE 'DISPATCHED' FROM A MAINT BASE (ZZZ AND XXX). WE CONFERRED WITH MAINT AND DISPATCH AND DETERMINED SINCE WE HAD BLOCKED OUT FROM THE GATE THAT WE WERE 'ENRTE.' THEREFORE, AN 'ENRTE MEL' WAS APPROPRIATE. UPON ARR AT YYY, DISPATCH NOTIFIED US THAT THE INTERP OF ENRTE MIGHT BE CHANGED AND THE INTERP OF ENRTE MIGHT BE CHANGED AND THE COMPANY WAS TRYING TO DETERMINE WHETHER OR NOT WE WERE ACTUALLY ENRTE OR NOT.
