Narrative:

Requested of ATC to climb from FL330 to FL370. ATC asked if we could be at FL370 in 3 mins. We accepted. At 1 min 20 seconds into climb, ATC asked if we were going to make it to FL370 in time. We responded that we were not -- our performance was now less than 1000 FPM and we would not make the climb restr. We were passing FL355. He asked us to turn 50 degrees left and asked another aircraft to turn 40 degrees left. We verified the request 1 more time before beginning the turn to a heading of 360 degrees. We saw an aircraft on TCASII approximately on the 10 mi arc and 1200 ft below us. We did get a momentary TA as we turned away from one another. We reported level at FL370 at 4 mins 30 seconds from the beginning of climb and ATC turned us back on course without further discussion or incident, other than we thanking the controller for his help and apologizing for the slow climb.

Title: B733 CREW UNABLE TO MAKE XING RESTR DUE TO DECREASED ACFT PERFORMANCE.

Narrative: REQUESTED OF ATC TO CLB FROM FL330 TO FL370. ATC ASKED IF WE COULD BE AT FL370 IN 3 MINS. WE ACCEPTED. AT 1 MIN 20 SECONDS INTO CLB, ATC ASKED IF WE WERE GOING TO MAKE IT TO FL370 IN TIME. WE RESPONDED THAT WE WERE NOT -- OUR PERFORMANCE WAS NOW LESS THAN 1000 FPM AND WE WOULD NOT MAKE THE CLB RESTR. WE WERE PASSING FL355. HE ASKED US TO TURN 50 DEGS L AND ASKED ANOTHER ACFT TO TURN 40 DEGS L. WE VERIFIED THE REQUEST 1 MORE TIME BEFORE BEGINNING THE TURN TO A HDG OF 360 DEGS. WE SAW AN ACFT ON TCASII APPROX ON THE 10 MI ARC AND 1200 FT BELOW US. WE DID GET A MOMENTARY TA AS WE TURNED AWAY FROM ONE ANOTHER. WE RPTED LEVEL AT FL370 AT 4 MINS 30 SECONDS FROM THE BEGINNING OF CLB AND ATC TURNED US BACK ON COURSE WITHOUT FURTHER DISCUSSION OR INCIDENT, OTHER THAN WE THANKING THE CTLR FOR HIS HELP AND APOLOGIZING FOR THE SLOW CLB.
