Narrative:

I am a captain for air carrier. We have a real safety problem that will only get worse due to management and the federal courts. In dec/99, the federal court imposed an injunction on the pilots with regards to maintenance write-ups. Now the attorneys representing the company have filed on our maintenance personnel. One of the problems management cited is the maintenance personnel's union instructed their people to go to the maintenance manuals when performing all tasks. This is a great safety enhancement due to the high number of new maintenance personnel. Lately we have had a high number of mechanics leave and take their experience elsewhere. Our aircraft are now showing it, too. On feb/xa/00 I had a generator drop offline on climb out -- it reset with no further action. Upon arrival in ZZZ, I spoke with line maintenance and they felt I should not make a maintenance log entry because it reset. My experience has shown that normally the generator is low on oil when they drop off, like this one did. Sure enough, next takeoff it dropped offline again. I then wrote it up as a recurring fault and deferred the generator. The problem could have been corrected in ZZZ, but now our maintenance personnel don't want to take the delay for fear of repercussion from management. Callback conversation with reporter revealed the following information: the reporter stated that after the generator dropped off the line twice, maintenance control insisted no logbook entry be made to the deferred item in the logbook. The reporter said the maintenance situation is bad and getting worse due to a court injunction limiting use of the maintenance manual. The reporter said most of the experienced technicians have left the carrier leaving inexperienced technicians who now have limited use of the maintenance manual. The reporter stated the current situation is the crews have a court injunction regarding maintenance write-ups and maintenance personnel have a court injunction on the use of the maintenance manual when performing all tasks.

Title: A CL65 WAS DISPATCHED IN NON COMPLIANCE WITH A GENERATOR DEFERRED AS INOP BUT WITHOUT MEL REQUIREMENTS ACCOMPLISHED.

THE PROB COULD HAVE BEEN CORRECTED IN ZZZ, BUT NOW OUR MAINT PERSONNEL DON'T WANT TO TAKE THE DELAY FOR FEAR OF REPERCUSSION FROM MGMNT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE RPTR STATED THAT AFTER THE GENERATOR DROPPED OFF THE LINE TWICE, MAINT CTL INSISTED NO LOGBOOK ENTRY BE MADE TO THE DEFERRED ITEM IN THE LOGBOOK. THE RPTR SAID THE MAINT SIT IS BAD AND GETTING WORSE DUE TO A COURT INJUNCTION LIMITING USE OF THE MAINT MANUAL. THE RPTR SAID MOST OF THE EXPERIENCED TECHNICIANS HAVE LEFT THE CARRIER LEAVING INEXPERIENCED TECHNICIANS WHO NOW HAVE LIMITED USE OF THE MAINT MANUAL. THE RPTR STATED THE CURRENT SIT IS THE CREWS HAVE A COURT INJUNCTION REGARDING MAINT WRITE-UPS AND MAINT PERSONNEL HAVE A COURT INJUNCTION ON THE USE OF THE MAINT MANUAL WHEN PERFORMING ALL TASKS.
