Narrative:

Location: gate xx oak. Condition affecting safety of flight. Upon preflight, found the forward galley door gust lock would not engage consistently. Following maintenance the door would not lock on the first attempt nor numerous other attempts. This is not considered functional as described by the MEL which defines 'inoperative' as when 'a system and/or a component malfunctions to the extent that it does not accomplish its intended purpose and/or is not consistently functioning within its design operating limits or tolerance(south).' this condition therefore appears to affect the safety of the operation of the aircraft, ie, airworthiness.

Title: AN S80 PIC REFUSES TO HAVE HIS ACFT DISPATCHED WITH THE FORWARD GALLEY DOOR GUST LOCK INOP AND LOGGED IN AS A DEFERRED ITEM IN ACCORDANCE WITH THE MANDATES OF THE MEL REQUIREMENTS.

THIS IS NOT CONSIDERED FUNCTIONAL AS DESCRIBED BY THE MEL WHICH DEFINES 'INOP' AS WHEN 'A SYS AND/OR A COMPONENT MALFUNCTIONS TO THE EXTENT THAT IT DOES NOT ACCOMPLISH ITS INTENDED PURPOSE AND/OR IS NOT CONSISTENTLY FUNCTIONING WITHIN ITS DESIGN OPERATING LIMITS OR TOLERANCE(S).' THIS CONDITION THEREFORE APPEARS TO AFFECT THE SAFETY OF THE OP OF THE ACFT, IE, AIRWORTHINESS.
