Narrative:

Flew same aircraft for 3 legs. Had an MEL for yaw damper ground test circuit. Procedure for this item said to test yaw damper during taxi. If one or both yaw dampers inoperative, observe inoperative performance limitations. Third item in procedures directed you to limitation correction section. Tested yaw dampers per MEL each leg. Both yaw dampers operated normally each leg. On third leg, a new dispatched limited our altitude and airspeed I called the dispatcher and asked why. He stated that we must take the corrections. I told him that both yaw dampers were operative and that as a crew we had interpreted the MEL as requiring no corrections. He stated that he felt we were wrong, and that the MEL expert worked day shift only, we were to take the correction even though we had not applied them on our first leg, and the flight plan did not call for them to be taken.

Title: A B727-200 WITH A DEFERRED YAW DAMPER GND TEST INOP WAS GIVEN SPD AND ALT RESTRS BY THE DISPATCHER THAT DID NOT APPLY TO THE DEFERRED ITEM.

Narrative: FLEW SAME ACFT FOR 3 LEGS. HAD AN MEL FOR YAW DAMPER GND TEST CIRCUIT. PROC FOR THIS ITEM SAID TO TEST YAW DAMPER DURING TAXI. IF ONE OR BOTH YAW DAMPERS INOP, OBSERVE INOP PERFORMANCE LIMITATIONS. THIRD ITEM IN PROCS DIRECTED YOU TO LIMITATION CORRECTION SECTION. TESTED YAW DAMPERS PER MEL EACH LEG. BOTH YAW DAMPERS OPERATED NORMALLY EACH LEG. ON THIRD LEG, A NEW DISPATCHED LIMITED OUR ALT AND AIRSPD I CALLED THE DISPATCHER AND ASKED WHY. HE STATED THAT WE MUST TAKE THE CORRECTIONS. I TOLD HIM THAT BOTH YAW DAMPERS WERE OPERATIVE AND THAT AS A CREW WE HAD INTERPED THE MEL AS REQUIRING NO CORRECTIONS. HE STATED THAT HE FELT WE WERE WRONG, AND THAT THE MEL EXPERT WORKED DAY SHIFT ONLY, WE WERE TO TAKE THE CORRECTION EVEN THOUGH WE HAD NOT APPLIED THEM ON OUR FIRST LEG, AND THE FLT PLAN DID NOT CALL FOR THEM TO BE TAKEN.
