Narrative:

Flight: pittsfield, ma, to bermuda. Aircraft: lear 25 with no HF. Preflight: pilot called local FSDO to go over regulation far 91.511. 91.511 gives the latitude/longitudes in which 2-WAY radio is not required for 30 mins on the airway from jfk to bermuda. FSDO didn't see any problem with what we wanted to do, so we proceeded to go. Upon reaching xfer point to HF from ZNY, we advised them of no HF, but we did have a sat phone. ZNY said they didn't want us to call on sat phone but to monitor 121.5 in case they needed to get a hold of us. We were out of 2-WAY radio for approximately 15 mins. After landing in bermuda, I called ZNY and they advised me that HF is required via an oceanic NOTAM and that the 30 min rule in far 91.511 is for emergency use only. FARS should clarify this rule! And I think for this trip sat phone and monitoring 121.5 should suffice for this.

Narrative: FLT: PITTSFIELD, MA, TO BERMUDA. ACFT: LEAR 25 WITH NO HF. PREFLT: PLT CALLED LCL FSDO TO GO OVER REG FAR 91.511. 91.511 GIVES THE LATITUDE/LONGITUDES IN WHICH 2-WAY RADIO IS NOT REQUIRED FOR 30 MINS ON THE AIRWAY FROM JFK TO BERMUDA. FSDO DIDN'T SEE ANY PROB WITH WHAT WE WANTED TO DO, SO WE PROCEEDED TO GO. UPON REACHING XFER POINT TO HF FROM ZNY, WE ADVISED THEM OF NO HF, BUT WE DID HAVE A SAT PHONE. ZNY SAID THEY DIDN'T WANT US TO CALL ON SAT PHONE BUT TO MONITOR 121.5 IN CASE THEY NEEDED TO GET A HOLD OF US. WE WERE OUT OF 2-WAY RADIO FOR APPROX 15 MINS. AFTER LNDG IN BERMUDA, I CALLED ZNY AND THEY ADVISED ME THAT HF IS REQUIRED VIA AN OCEANIC NOTAM AND THAT THE 30 MIN RULE IN FAR 91.511 IS FOR EMER USE ONLY. FARS SHOULD CLARIFY THIS RULE! AND I THINK FOR THIS TRIP SAT PHONE AND MONITORING 121.5 SHOULD SUFFICE FOR THIS.
